Vendimi i gjykat\u00ebs anuloi n\u00eb t\u00ebr\u00ebsi aktet administrative t\u00eb Inspektoratit t\u00eb Pun\u00ebs q\u00eb k\u00ebrkonin anulimin e vendimeve p\u00ebr mosvazhdim t\u00eb marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs s\u00eb punonj\u00ebsve t\u00eb Limakut, shkruan Demokracia.com.<\/strong><\/p>\n\n\n\n

N\u00eb nj\u00eb vendim t\u00eb dat\u00ebs 12 korrik 2024, gjykata ka aprovuar k\u00ebrkes\u00ebn e padit\u00ebsit, \u201cLimak Kosovo International Airport J.S.C Adem Jashari\u201d, duke anuluar vendimet e Inspektorit t\u00eb Pun\u00ebs q\u00eb synonin t\u00eb shfuqizonin 23 vendime p\u00ebr mosvazhdim t\u00eb marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs dhe 28 njoftime t\u00eb ngjashme. Ky vendim vler\u00ebson se Inspektorati i Pun\u00ebs ka tejkaluar kufijt\u00eb e kompetenc\u00ebs s\u00eb tij ligjore, duke marr\u00eb vendime q\u00eb mbi tejkalojn\u00eb autoritetin e p\u00ebrcaktuar nga ligji.<\/p>\n\n\n\n

N\u00eb padi, Limak Kosovo International Airport ka argumentuar se vendimet e Inspektorit t\u00eb Pun\u00ebs jan\u00eb n\u00eb kund\u00ebrshtim me Ligjin Nr. 03\/L-212 t\u00eb Pun\u00ebs dhe Ligjin Nr. 2002\/9 p\u00ebr Inspektoratin e Pun\u00ebs, t\u00eb cil\u00ebt qart\u00ebsojn\u00eb kompetencat ekskluzive t\u00eb gjykatave n\u00eb trajtimin e kontesteve t\u00eb pun\u00ebs. Sipas padit\u00ebsit, Inspektorati i Pun\u00ebs nuk ka autorizim p\u00ebr t\u00eb anuluar vendimet e marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs, pasi kjo \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi e gjykatave sipas parimeve t\u00eb qarta ligjore, raporton Demokracia.com.<\/p>\n\n\n\n

Gjykata, duke analizuar dispozitat e Ligjit t\u00eb Pun\u00ebs dhe Ligjit p\u00ebr Inspektoratin e Pun\u00ebs, ka konstatuar se Inspektorati i Pun\u00ebs nuk posedon kompetenc\u00eb gjyq\u00ebsore p\u00ebr t\u00eb anuluar vendimet e padit\u00ebsit. N\u00eb vend t\u00eb k\u00ebsaj, vet\u00ebm gjykatat kan\u00eb autoritetin p\u00ebr t\u00eb vler\u00ebsuar dhe anuluar vendimet administrative n\u00eb kontekstin e marr\u00ebdh\u00ebnieve t\u00eb pun\u00ebs.<\/p>\n\n\n\n
